On 26 May 2011, the Bundestag passed the amendments to the right of withdrawal and return under distance selling law. On 4 August 2011, the Act on the Adjustment of the Provisions on Value Replacement in the Case of Cancellation of Distance Contracts and on Related Contracts came into force.
Cancellation policies drawn up according to the "old" legal situation must now be adapted to the new legal regulations in a timely manner. Since the law provides for a transitional period of 3 months, traders can still use the cancellation policies created according to the "old" legal situation until 4 November 2011. During this period, the use of "old" cancellation policies does not threaten any warnings under competition law. From 5 November 2011 at the latest, however, all traders must use the new cancellation and return policy. Otherwise there is a risk of a warning under competition law.
