Legal standing of the chambers of industry and commerce

The Kammergericht Berlin (Berlin Court of Appeal) held that the Chambers of Industry and Commerce have the right to sue under Section 8(III) No. 4 UWG without being limited to a specific competitive relationship in matters of competition law.

The Chambers of Commerce and Industry are always entitled to make claims when it comes to competition violations by companies from industry and commerce.

In the case at issue, an e-mail advertisement touched on the area of hotel services. This area falls within the subject-matter jurisdiction of the Chambers of Industry and Commerce. For this reason, the Chamber of Industry and Commerce had comprehensive jurisdiction in this dispute.
