Works council must be equipped with technology for video conferencing

Zoom, MS Teams and Co. for the Operations Council

The Berlin-Brandenburg Regional Labour Court (Landesarbeitsgericht Berlin-Brandenburg) ordered an employer by way of an interim injunction to provide the existing works council with technical equipment enabling it to hold meetings and consultations in the form of a video conference. In its reasoning, the Regional Labour Court stated that this was necessary information technology which the employer had to provide under section 40 (2) of the Works Constitution Act.

There is no further right of appeal against the decision of the Regional Labour Court.
