No trademark owner wants their trademark to be completely or partially deleted.

How can a trademark be canceled?

E.g. if the owner of the trademark does not seriously use his trademark for (all) goods or services for which the trademark is registered.

Cancellation or partial cancellation of a trademark

You must use your trademark for all registered goods and services of the trademark after the grace period of 5 years has expired. There is an obligation to use the trademark. Otherwise, a third party can file an application for revocation of the trademark.

If this application is successful, your trademark will then be fully or partially canceled.

Documentation of trademark use

You must therefore sufficiently document the (complete) use of the trademark for (all) registered goods or services over the years of trademark use so that you can also prove the complete use of the trademark in the event of an application for revocation of the trademark.

If you cannot prove the (complete) use of the trademark for (all) registered goods or services to the satisfaction of the trademark offices, there is a risk of partial cancellation of the trademark for certain goods and services or even complete cancellation of the registered trademark.

Missing or inadequate documentation of trademark use may therefore lead to your trademark being canceled.
