Copyright infringements by "Bushido" in several cases

According to press reports, the Hamburg Regional Court (Landgericht Hamburg) has ruled under the case numbers 310 O 155/08 and 308 O 175/08 in

Numerous warnings must be re-examined.

According to available press reports, the Hamburg Regional Court (Landgericht), under the case numbers 310 O 155/08 and 308 O 175/08, has found - in judgements that are not yet final - that the Berlin-based musician Anis Mohammed Ferchichi, better known under the stage name "Bushido", is alleged to have committed copyright infringements in several songs published under his label. The French gothic band "Dark Sanctuary" had sued the "gangster rapper" for unauthorised use of 16 of their tracks and passing them off as his own. On Tuesday, 23.03.2010, the Regional Court sentenced the musician to pay damages to the authors

Among others, the albums affected are

  • - "Janine,
  • - "Bravo Hits 56", and
  • - "The Dome Vol. 41.

The pieces of music listed in the judgement include:

  • - Sex in the City,
  • - "Bloodsport2,
  • - "Gold rapper,
  • - "Janine,
  • - "It's ok",
  • - "Tear of Blood"
  • - "Back from the skyline to the kerb again".

The complete list of music has not yet been published. Because of these albums, songs and other pieces of music, the artist "Bushido" has had numerous warnings issued in the past - among others also against many of our clients - also by the lawyers Binhardt -Fielder - Rixen - Zerbe, because the pieces of music are said to have been illegally reproduced on the internet in music file sharing networks and file sharing systems. As a rule, lump sums of approx. € 350.00 - € 800.00 were demanded and partly collected as compensation for the "copyright infringements".

Should the decision of the Hamburg Regional Court become legally binding, all warnings must be reviewed for their justification.

If cease-and-desist declarations have been issued and damages have been paid, these transactions may have to be reversed because of the music pieces concerned.

The affected persons who have been warned and have paid without having been advised by a lawyer should immediately consult a specialised lawyer and have the procedures reviewed.
