E-mail addresses - no claim to surrender to WEG member

As the Düsseldorf Regional Court has now found in a decision (ruling of 4 October 2018, file number 25 S 22/18), a condominium owner has no right to demand that the administrator of the condominium owners' association surrender the email addresses of the other condominium owners to the condominium owner.

An administrator of a condominium owners' association is only obliged to hand over a list with the names and addresses of the entire condominium owners to a condominium owner upon request.

The judges based their legal opinion on the fact that there was a significant difference in the manner, diligence and intensity of the use of e-mails compared to postal correspondence. Therefore, the administrator did not have to hand over the e-mail addresses.

However, each individual condominium owner could obtain knowledge of the individual e-mail addresses of the other condominium owners by inspecting the administrative documents of the condominium owners' association and then use them on his or her own responsibility, taking into account the provisions of data protection law.
