Email Addresses – No Right to Disclosure to a Co-owner

As the Düsseldorf Regional Court has now determined in a ruling (judgment of October 4, 2018, file number 25 S 22/18), a condominium owner has no right to demand that the administrator of the condominium owners' association disclose the email addresses of the other condominium owners to them.

An administrator of a condominium owners' association is only obligated, upon request, to provide a list containing the names and postal addresses of all condominium owners to a condominium owner.

The judges justified their legal opinion by stating that there is a significant difference in the manner, diligence, and intensity of using emails compared to postal correspondence. Therefore, the administrator is not required to disclose the email addresses.

However, each individual condominium owner can independently obtain knowledge of the email addresses of other condominium owners by inspecting the administrative documents of the condominium owners' association and then use them under their own responsibility, taking into account data protection regulations.
